Is gambling illegal in Japan?

Gambling has been practiced in Japan since ancient times, as recorded in the Chronicles of Japan in 685. Games have changed over time, with Karuta becoming popular in ancient times and Hanafuda (Japanese playing cards) in the Edo period (1603-1867), but today Japan is home to Horse racing, Bicycle racing, Boat racing, the lotteries, and Pachinko (Japanese pinball).

So, is gambling legal in Japan? The answer is NO. Gambling is an illegal act prohibited by Articles 185 and 186 of the Penal Code. Violators are subject to a fine of up to 500,000 yen($4000) or imprisonment for up to three years.

So why do Pachinko, horse racing, and other forms of gambling exist? There are two reasons.
One is what is called public gambling, which is operated by the government. These include horse racing, boat racing, bicycle racing, and the lotteries. Boat and bicycle races are unique in Japan and rare in the world.
Another reason is that they are in the gray zone but are tacitly permitted. These include Pachinko and Pachislot.

So why do they exist? This is because they existed before pachinko was legalized and because of a system called the "3 parlor system," in which pachinko parlors give prizes instead of cash, which are then exchanged for cash at another store (often located next to the pachinko parlor). This means that, by definition, Pachinko parlors do not engage in gambling.

Now, in this article, I wrote about the gambling industry in Japan. Comparing the market sizes of Japan and the U.S., we can see that the U.S. casino market is about 5 trillion yen($40 billion), while the Japanese gambling market earns around 24 trillion yen($190 billion) a year, making Japan one of the largest gambling nations in the world.

Recently, however, the number of Pachinko parlors has been decreasing as more and more people say that Pachinko has become less interesting due to stricter regulations. Instead, online casinos are becoming popular in Japan. In addition, a bill to create a resort facility including casinos in Japan has recently been approved. In the future, we may be able to enjoy casinos in Japan.
